The Supreme Court ruled last December that child pornography can include sexually explicit images of cartoon characters.

McGuire changed his plea in Newcastle Local Court yesterday to guilty and was convicted, fined $1000 and put on a 12-month good behaviour bond.

The Supreme Court ruling came after a man was convicted in Parramatta Local Court in February last year of possessing pornographic images of child cartoon characters.

Justice Michael Adams agreed with the local court magistrate that the images could be classed as child pornography.

That ruling extended the legal definition of "person" to include cartoon characters.

Police searched McGuire's home in April last year and seized his computer and disks before charging him.

The case was delayed to await the Supreme Court's decision.

Defence barrister Mark Preece told the court yesterday that McGuire, of Renfrew Crescent, Edgeworth, received the images "mischievously" while downloading music and video files from Limewire.

"It's the sort of spam email garbage that is disseminated all around this country every day," Mr Preece said.

"The images are at the extreme lowest end of the scale.

"He's extremely embarrassed about the nature of the charge.

"To say that this is a very unfortunate matter is probably a gross understatement."

Magistrate Sharon Holdsworth said that even though the images did not depict actual children being exploited, the need remained to deter members of the community from viewing or disseminating such images.

"There have been rather extraordinary circumstances in this case," she said.

"It was both necessary and appropriate to await the Supreme Court decision."

Watch this happen in the U.S. and have all the loli and shota bastards get taken to jail.
I find it a bit stupid since it's cartoon characters, but then again they're also children...
Then again it could have been spam while downloading illegal music.

I read it as saying it's against the law to be in posession of indecent cartoons of children.

I'm guessing the offending Pokemon images were of the human characters, not Pokemon themselves.

So I guess the furfags are safe.

When the police get involved with confiscating artwork and think they have the right to pass judgement on it being offensive or not...

...it's a sure sign of a government heading toward a totalitarian society.

I'm all for protecting children, but this is on a par with accusing someone of being guilty of murder for having killed somebody in a videogame.

The sad thing is, most people don't see it like that. They just see the sick pedophile. They don't care how unfair or how totalitarian the laws that led to his arrest are because A) he's a pedophile and B) they're not pedophiles, so the laws in question don't effect them. Don't get me wrong, I think pedophilia is sick, but you're right, this man WAS arrested for thought crime.

People only care about unjust laws and methods when they themselves are directly threatened by those laws or methods. That's why there wasn't more of an upset about the Military Commissions Act; after all, who cares if a terrorist doesn't get the rights afforded to him by the Geneva conventions, habeus corpus and the Bill of Rights? He's a daisies terrorist.
