 Originally, he had been claiming to have a mental disorder, but he never specified what it was. When it was revealed that ADD was the only known disorder he had, they basically dropped the idea his disorder had anything to do with his actions. But then in its place, it was brought up whether or not he has undiagnosed problem(s), or if the dog was barking so badly he couldn't get to sleep at night and was eventually in such a state of mind what happened happened because of that. My personal opinion is disbelief, because he was still going to work beforehand, and if he did go camping before the incident, why didn't he get the sleep he needed then? Not to mention the rest of the neighbourhood reported that the dog didn't bark excessively in the first place.

They don't just let the "mentally unstable" guys go 'free". They just don't go to jail.
 He is being prosecuted, but like I said in my above post, he might be let go if they decide his actions were caused by sleep deprivation. They couldn't put him in a nut house if he was only like that when he was pushed so far, but... like I said, I don't believe he was.
